Why should I hire an attorney?
Only an attorney can review the facts of your matter and be able to tell you if you have a strong case.
If I have not made my payment, wouldn’t the bank automatically win in court?
Not necessarily. If you are willing to fight the foreclosure, the bank will have to prove that they have the right to foreclose, i.e., that you have not made your payments or otherwise voided the contract. Banks do not always have the necessary paperwork.
How much time do I have to decide what to do?
Time is very short if you have been served with a Complaint. You typically have 20 days to file a written response.
What happens if I do nothing?
The bank will win by default, and will not have to go through the process of proving their claim.
How long does a foreclosure case last?
This can vary widely from a few months, if you do not defend the case, to as long as a few years, if you do.
